What is Consequences of misclassifying employees as independent contractors?
Nexa Consultancy | Startup & Finance Glossary
Misclassifying employees as "consultants" or "freelancers" to avoid payroll taxes (PF, ESI) and other employee benefits is illegal. If caught, the company can be liable for all past unpaid contributions, along with heavy penalties and interest.
Startup Example: A startup has a team of 20 people all on "consultant" agreements. A labor inspection reveals they function as employees. The startup is forced to pay years of back-dated PF contributions plus penalties.
Our compliance guides cover correct employee classification.
